Please read these terms carefully before using Persona Audit. By creating an account or using the service, you agree to be bound by these terms.
These Terms of Service (“Terms”) are a legal agreement between you (“User”, “you”) and Nyche Marketing, a sole proprietorship registered in Alberta, Canada, operating Persona Audit at https://personaaudit.com (“we”, “us”, “our”).
Persona Audit provides AI-powered website audits that evaluate publicly accessible URLs against buyer persona criteria across multiple dimensions including SEO, messaging, trust signals, UX, and conversion rate optimisation. The service also includes persona building tools, page copy generation, and reporting features.
You must be at least 18 years old and capable of forming a binding contract to use Persona Audit. By using the service, you represent that you meet these requirements. The service is intended for business use; you represent that you are using it for commercial or professional purposes.
You must create an account to access most features. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use at noreply@personaaudit.com.
You agree to use Persona Audit only for lawful purposes and in accordance with our Acceptable Use Policy. You must not submit URLs or persona data that you do not have the right to analyse, or use the service in any way that violates applicable law.
Persona Audit uses large language models (including Anthropic's Claude) to generate audit reports, recommendations, and page copy. You acknowledge and agree that:
The Persona Audit platform, software, design, and proprietary content are owned by Nyche Marketing and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the service.
You retain ownership of the URLs, persona descriptions, and business information you submit. By submitting content, you grant us a limited licence to process it solely for the purpose of providing the service to you. We do not use your submitted content to train AI models.
Audit reports and page copy generated for your account are yours to use for your own business purposes. You may not resell raw Persona Audit output as your own standalone product without our written permission.
Paid plans are billed on a recurring monthly basis via Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months except where required by law or at our sole discretion.
We reserve the right to change pricing with 30 days' notice to active subscribers. Continued use after a price change constitutes acceptance.
The free plan is provided as-is without any service level guarantees. During the BETA period, features may change, be removed, or be made paid without notice. We are not liable for any loss resulting from changes to free-tier or BETA features.
To the maximum extent permitted by applicable law, Nyche Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or relating to your use of Persona Audit, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amounts you paid us in the 3 months preceding the claim, or (b) CAD $100.
You agree to indemnify, defend, and hold harmless Nyche Marketing and its owner, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the service.
Persona Audit is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that audit results will be accurate or complete.
The service integrates with third-party platforms including Clerk, Stripe, Anthropic, and others. We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is governed by their respective terms and policies.
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason at our sole discretion. You may delete your account at any time. Upon termination, your right to use the service ceases immediately.
These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.
We may update these Terms from time to time. We will notify registered users of material changes by email or site notice at least 14 days before they take effect. Continued use of the service after changes take effect constitutes your acceptance of the revised Terms.
